PLEASE READ THESE TERMS OF SERVICE CAREFULLY. These Terms of Service (“Terms”) govern your access to and use of the website located at mbsnutra.com (the “Site”) and your purchase of any products offered through the Site, including our Hair Revitalization Serums, Complete Hair Growth Kit, Complete Pigment Restoration Kit, and any other products (collectively, the “Products”). The Site and Products are provided by MBS Nutra (“MBS Nutra,” “we,” “us,” or “our”), a business operating in the State of California.

THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER (SECTION 15). They affect how disputes between you and MBS Nutra are resolved. Please review them carefully.

1. Acceptance of These Terms

By accessing or using the Site, creating an account, or purchasing any Product, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Site or purchase our Products.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to purchase Products from the Site. By using the Site, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Products; Not Medical Advice

Our Products are cosmetic hair care products formulated with ingredients such as black cumin (Nigella sativa) seed oil. They are intended for external, topical use only unless otherwise indicated on the label.

FDA Disclaimer. Statements regarding our Products have not been evaluated by the U.S. Food and Drug Administration. Our Products are not intended to diagnose, treat, cure, or prevent any disease.

Not Medical Advice. Content on the Site, including descriptions of ingredients and their traditional or studied uses, is provided for informational purposes only and is not medical advice. Consult a physician or qualified healthcare provider before using any Product if you are pregnant, nursing, have a medical condition (including scalp or skin conditions), or are taking medication. Discontinue use and consult a healthcare provider if irritation or an adverse reaction occurs.

Individual Results. Results vary from person to person. Testimonials and before-and-after images on the Site reflect individual experiences and are not a guarantee of your results.

4. Orders, Pricing, and Payment

All orders placed through the Site are offers to purchase that we may accept or decline in our sole discretion, including due to product availability, errors in pricing or product information, or suspected fraud. Prices are displayed in U.S. dollars and are subject to change at any time without notice, except that price changes will not affect orders already accepted. You are responsible for any applicable taxes. By providing a payment method, you represent that you are authorized to use it and authorize us (and our third-party payment processors) to charge it for your order, including applicable taxes and shipping fees.

5. Subscriptions and Auto-Renewal

HOW SUBSCRIPTIONS WORK. We offer certain Products on a subscription basis. When you enroll in a subscription, you will receive the selected Product(s) on a recurring monthly basis, and you authorize us to automatically charge your payment method the then-current subscription price, plus applicable taxes and shipping, on each recurring billing date, until you cancel.

CANCEL ANYTIME. There is no minimum commitment. You may cancel your subscription at any time, effective for future shipments, by any of the following methods:

• Logging into your account on the Site and managing your subscription settings; or

• Emailing us at contact@mbsnutra.com with your name and order information.

To avoid being charged for the next shipment, cancel at least 48 hours before your next scheduled billing date. Cancellation stops future charges and shipments but does not automatically refund prior charges; however, prior orders may still qualify for our 90-Day Money-Back Guarantee (Section 6).

Price Changes. We may change subscription pricing with reasonable advance notice to you (e.g., by email). If you do not agree to a price change, you may cancel before it takes effect.

Payment Failures. If a payment fails, we may retry the charge and/or suspend or cancel your subscription.

6. 90-Day Money-Back Guarantee

We stand behind our Products. If you are not satisfied with a purchase for any reason, you may request a full refund of the purchase price within ninety (90) days of the date of the charge for that order.

• The guarantee applies to any order, including individual subscription shipments (measured from the billing date of each shipment).

• You do not need to return the Product to qualify.

• To request a refund, email contact@mbsnutra.com with your name, order number, and the email address used at checkout.

• Approved refunds are issued to the original payment method, typically within 5–10 business days of approval. Original shipping charges, if any, are not refunded.

We reserve the right to refuse refunds where we reasonably determine abuse of this guarantee, including repeated claims across multiple accounts or orders placed for resale. Refunding an order does not cancel an active subscription; to stop future shipments, you must also cancel per Section 5.

7. Shipping and Delivery

Shipping timelines shown at checkout are estimates only and are not guaranteed. Risk of loss and title pass to you upon our delivery of the Products to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other events outside our reasonable control. If your order arrives damaged or does not arrive, contact us at contact@mbsnutra.com and we will work with you to resolve the issue.

8. Promotions and Discount Codes

Promotions, discount codes, and bundle pricing are subject to the terms stated in the offer, may not be combined unless expressly stated, have no cash value, and may be modified or discontinued at any time. We may cancel orders that misuse promotional offers.

9. Intellectual Property

The Site and all of its content — including text, images, product names, formulations, branding, logos, graphics, videos, and software — are owned by or licensed to MBS Nutra and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent. "MBS Nutra" and our product names and logos are our trademarks and may not be used without permission.

10. User Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) interfere with the operation of the Site; (d) scrape, harvest, or collect data from the Site by automated means; (e) purchase Products for unauthorized resale; or (f) impersonate any person or misrepresent your affiliation with any person or entity.

11. User Content and Reviews

If you submit reviews, photos, testimonials, comments, or other content to us or the Site (“User Content”), you grant MBS Nutra a non-exclusive, royalty-free, worldwide, perpetual, transferable license to use, reproduce, modify, display, and distribute that User Content in connection with our business, including in advertising and marketing. You represent that your User Content is accurate, reflects your genuine experience, and does not violate any third party’s rights. We may remove or decline to post any User Content at our discretion.

12. Third-Party Links and Services

The Site may contain links to third-party websites or services (including payment processors and social media platforms). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any Product will achieve any particular result for you. Nothing in this section limits the 90-Day Money-Back Guarantee described in Section 6 or any rights you have under applicable law that cannot be disclaimed.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MBS NUTRA AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution First. Before filing a claim, you agree to contact us at contact@mbsnutra.com and give us 30 days to attempt to resolve the dispute informally.

Binding Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in the county where you reside or another mutually agreed location, or remotely. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver. YOU AND MBS NUTRA EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

Opt-Out. You may opt out of this arbitration agreement by emailing contact@mbsnutra.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out of arbitration.

16. Governing Law

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of California, without regard to its conflict of laws principles, except that the Federal Arbitration Act governs Section 15. For any claims not subject to arbitration, you and MBS Nutra consent to the exclusive jurisdiction of the state and federal courts located in Fresno County, California.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a revised “Last Updated” date, and material changes to subscription terms will be communicated to active subscribers by email. Your continued use of the Site or Products after changes take effect constitutes acceptance of the updated Terms.

18. Termination

We may suspend or terminate your access to the Site or refuse orders at any time for conduct that violates these Terms or is otherwise harmful to us or other users. Sections that by their nature should survive termination (including Sections 9, 13, 14, 15, and 16) will survive.

19. General

These Terms, together with our Privacy Policy and any terms presented at checkout, constitute the entire agreement between you and MBS Nutra regarding the Site and Products. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
